• Usage data (features used, session duration, interactions)
• Crash logs and diagnostics for performance monitoring

C. Information from Third Parties

• SMS delivery providers (e.g., Twilio)
• Analytics providers (e.g., Google Analytics)
• Payment processors (where applicable)
• Advertising and sponsorship platforms

2. How We Use Information

We use information to:

• Operate and deliver core games, leagues, and scoring functionality
• Send invites, confirmations, reminders, and service notifications
• Display standings, results, and historical game data
• Provide customer support and troubleshoot issues
• Improve product performance, usability, and reliability
• Prevent fraud, abuse, and unauthorized access
• Comply with legal obligations

3. Sharing of Information

We may share information with:

• Service providers who support app operations (hosting, SMS, analytics)
• Game organizers and clubs for visibility into participation and results within games you join
• Advertising partners, limited to aggregated and non-sensitive metrics
• Legal or regulatory authorities when required by law

We do not sell personal information.

4. Advertising & Sponsorships

The Services may display advertisements or sponsorship messages. Advertisers do not receive your sensitive personal data from us. Advertising activity is governed by our Advertising Policy.

5. Data Retention

We retain information for as long as necessary to:

• Provide the Services
• Maintain game history and records
• Comply with legal, tax, and dispute-resolution obligations

You may request deletion, subject to operational and legal requirements.

6. Your Rights

Depending on your jurisdiction, you may have rights to:

• Access, correct, or delete your data
• Opt out of certain communications
• Request information about data use

7. Account Deletion

You may delete your GameDay Pro account directly within the GameDay Pro mobile app.

To delete your account:

• Open the GameDay Pro app
• Go to Settings
• Select Delete Account
• Follow the prompts to confirm your request

When you delete your account, GameDay Pro will remove or deactivate your account information from our active systems, subject to any information we are required or permitted to retain for legal, security, fraud prevention, accounting, dispute resolution, or legitimate business purposes.

Deleting your account may also remove access to your player profile, club or group memberships, game history, scoring history, league participation, standings, messages, notifications, and other app-related data associated with your account.

If you are unable to access the app or need assistance deleting your account, please email privacy@gamedaypro.io.

8. Security

We use reasonable administrative, technical, and organizational safeguards, but no system is completely secure.

9. Changes

We may update this Privacy Policy. Continued use of the Services constitutes acceptance of the updated policy.

By accessing or using GameDay Pro, including our mobile application, website, software, tools, features, and related services (collectively, the “Services”), you agree to these Terms of Service (“Terms”).

If you do not agree to these Terms, do not access or use the Services.

1. Eligibility

You must be at least 13 years old to use the Services.

By using the Services, you represent that you meet this eligibility requirement and that you have the legal authority to agree to these Terms.

2. Accounts

You are responsible for:

• Maintaining the confidentiality of your login credentials
• All activity that occurs under your account
• Ensuring that account information you provide is accurate and current
• Promptly notifying GameDay Pro of any unauthorized access or suspected security issue

GameDay Pro is not responsible for losses arising from your failure to protect your account credentials.

3. Acceptable Use

You agree not to:

• Use the Services for unlawful purposes
• Harass, threaten, abuse, or impersonate other users
• Manipulate scores, results, standings, or game data dishonestly
• Interfere with system functionality, performance, availability, or security
• Attempt to gain unauthorized access to the Services or related systems
• Upload or distribute malicious code, spam, or harmful content
• Use the Services to infringe or violate the intellectual property, privacy, publicity, or other rights of any third party
• Use the Services for unauthorized gambling, wagering, or illegal prize activity
• Use the Services in any way that violates these Terms or applicable law

4. Clubs, Games, and Organizers

GameDay Pro allows users and organizers to create or manage clubs, groups, games, leagues, trips, competitions, pairings, scoring, results, standings, communications, and related activities.

A “Club” in GameDay Pro may refer to a private golf group, league, public course group, private club group, golf trip group, recurring game community, or similar user-managed group within the Services.

Administrators and organizers are responsible for the clubs, games, leagues, events, members, settings, rules, messages, and content they create or manage through the Services.

5. Games, Scoring, and Results

GameDay Pro provides scoring and game management tools for recreational and organizational use.

Users are solely responsible for the accuracy of scores, handicaps, pairings, game data, rules, results, standings, and related information entered into or managed through the Services.

GameDay Pro does not independently verify the accuracy of scores, results, standings, payouts, or game data and is not responsible for disputes between participants, organizers, clubs, courses, sponsors, advertisers, or other users.

6. Competition Organizer Responsibility

Event organizers are solely responsible for:

• Establishing game, league, tournament, or competition rules
• Determining eligibility
• Creating pairings, teams, divisions, flights, formats, and scoring rules
• Determining winners, standings, results, and payouts
• Resolving disputes between participants
• Communicating official rules and updates
• Complying with all applicable laws and regulations

GameDay Pro provides tools to help manage games and competitions but does not act as the official organizer, referee, judge, administrator, or governing body for user-created activities.

7. Prize Pools, Wagers, and Payouts

GameDay Pro does not organize, operate, manage, sponsor, or administer wagering, gambling, betting, prize pools, or payouts.

Any prize pools, wagers, bets, payouts, side games, or similar activities are conducted solely by users or organizers and are not controlled by GameDay Pro.

Users and organizers are solely responsible for determining whether any such activity is lawful in their jurisdiction and for complying with all applicable laws, rules, and regulations.

GameDay Pro disclaims all responsibility for user-created wagering, prize, payout, gambling, or similar activity.

8. Payments

Payments, if applicable, may be processed by third-party payment providers.

GameDay Pro does not store payment card credentials unless expressly stated otherwise. Payment processing is subject to the applicable third-party provider’s terms, policies, and security practices.

You are responsible for all fees, taxes, and charges associated with your subscription or use of paid features.

9. Subscriptions

GameDay Pro may offer free and paid subscription tiers based on club, group, or subscriber size and available features.

Unless otherwise stated:

• Players may download the app for free
• Clubs or groups of four or fewer players may be eligible for free use
• Larger clubs, groups, leagues, or organizers may require a paid subscription
• Subscription terms, pricing, included players, and available features may vary

GameDay Pro may change pricing, subscription tiers, included features, or billing practices from time to time. Any material changes will apply prospectively unless otherwise stated.

10. Advertising and Sponsored Content

The Services may include advertisements, sponsored content, promotions, or similar placements.

GameDay Pro is not responsible for third-party offers, products, services, claims, promotions, advertisements, or advertiser content.

Users, subscribers, clubs, organizers, sponsors, or advertisers who submit advertising or promotional content are solely responsible for that content and must ensure they have all necessary rights, permissions, and approvals.

GameDay Pro may remove or restrict advertisements or sponsored content that it believes may violate these Terms, applicable law, or third-party rights.

11. User Content and Permissions

“User Content” means any content, information, or materials submitted, uploaded, entered, displayed, transmitted, or otherwise provided by users, subscribers, clubs, organizers, advertisers, or sponsors through the Services.

User Content may include, without limitation:

• Club names
• Course names
• Game names
• League names
• Player information
• Scores
• Results
• Standings
• Handicaps
• Pairings
• Messages
• Announcements
• Advertisements
• Sponsor content
• Logos
• Images
• Text
• Rules
• Event descriptions
• Other materials provided through the Services

You retain ownership of your User Content. By submitting User Content to the Services, you grant GameDay Pro a non-exclusive, worldwide, royalty-free license to host, store, reproduce, display, process, transmit, modify, and use that User Content as necessary to operate, provide, improve, support, and promote the Services.

You represent and warrant that you own or have all necessary rights, licenses, consents, and permissions to submit, upload, display, or use your User Content through the Services.

You may not submit or use User Content that infringes, misappropriates, or violates any copyright, trademark, privacy, publicity, contractual, or other rights of any third party.

GameDay Pro may remove, restrict, or disable access to any User Content that it believes may violate these Terms, applicable law, or third-party rights.

12. Intellectual Property

The Services, including the software, application, website, designs, interfaces, text, graphics, logos, trademarks, service marks, trade names, icons, features, functionality, and other materials provided by GameDay Pro, are owned by GameDay Pro or its licensors.

No rights are granted to you except as expressly stated in these Terms.

You may not copy, modify, distribute, sell, lease, reverse engineer, decompile, disassemble, or create derivative works based on the Services except as permitted by applicable law or expressly authorized by GameDay Pro in writing.

The name “GameDay Pro,” the GameDay Pro logo, and related brand elements may not be used without prior written permission from GameDay Pro.

13. Third-Party Content and Services

The Services may include, link to, display, or integrate with third-party content, websites, services, payment processors, advertisers, sponsors, or other third-party materials.

GameDay Pro does not control and is not responsible for third-party content, products, services, policies, or practices.

Your use of third-party services may be subject to additional terms and policies provided by those third parties.

14. Privacy

Your use of the Services is also subject to any privacy policy made available by GameDay Pro.

By using the Services, you agree that GameDay Pro may collect, use, store, and process information as described in its privacy policy and as necessary to provide the Services.

15. Disclaimers

THE SERVICES ARE PROVIDED “AS IS” AND “AS AVAILABLE,” WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, STATUTORY, OR OTHERWISE.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, GAMEDAY PRO DISCLAIMS ALL WARRANTIES, INCLUDING ANY IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, NON-INFRINGEMENT, ACCURACY, AVAILABILITY, RELIABILITY, AND SECURITY.

GAMEDAY PRO DOES NOT WARRANT THAT:

• The Services will be uninterrupted, error-free, secure, or available at all times
• Scores, results, standings, pairings, payouts, or game data will be accurate
• User Content will be preserved or free from loss
• Disputes between users will be resolved through the Services
• The Services will meet your specific requirements

GameDay Pro is not responsible for user mistakes, incorrect scores, inaccurate data entry, event disputes, organizer decisions, prize disputes, wager disputes, or third-party conduct.

16. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, GAMEDAY PRO AND ITS OWNERS, OPERATORS, EMPLOYEES, CONTRACTORS, AFFILIATES, LICENSORS, AND SERVICE PROVIDERS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, INCLUDING LOST PROFITS, LOST REVENUE, LOST DATA, LOSS OF GOODWILL, BUSINESS INTERRUPTION, OR OTHER INTANGIBLE LOSSES ARISING OUT OF OR RELATED TO YOUR USE OF OR INABILITY TO USE THE SERVICES.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, GAMEDAY PRO’S TOTAL LIABILITY FOR ANY CLAIM ARISING OUT OF OR RELATED TO THE SERVICES OR THESE TERMS WILL NOT EXCEED THE GREATER OF:

• The amount you paid to GameDay Pro for the Services during the twelve months before the claim arose
• One hundred dollars ($100)

Some jurisdictions do not allow certain limitations of liability, so some of the above limitations may not apply to you.

17. User Indemnification

You agree to defend, indemnify, and hold harmless GameDay Pro, its owners, operators, employees, contractors, affiliates, licensors, and service providers from and against any claims, damages, liabilities, losses, costs, and expenses, including reasonable attorneys’ fees, arising out of or related to:

• Your use of the Services in violation of these Terms or applicable law
• Your User Content
• Any scores, names, logos, images, messages, advertisements, club information, game information, league information, player information, or other materials you submit, upload, publish, display, or control through the Services
• Your violation of any third-party intellectual property, privacy, publicity, contractual, or other rights
• Your organization, operation, management, or administration of games, events, leagues, competitions, prize pools, wagers, payouts, advertisements, sponsorships, or promotions
• Disputes between you and other users, players, organizers, clubs, courses, sponsors, advertisers, or third parties
• Your negligence, misconduct, fraud, or unlawful activity

18. GameDay Pro Intellectual Property Indemnification

GameDay Pro will defend and indemnify a paying subscriber against any third-party claim alleging that the subscriber’s authorized use of the GameDay Pro software, as provided by GameDay Pro and used in accordance with these Terms, directly infringes that third party’s United States copyright, trademark, or other intellectual property rights.

This indemnity applies only to claims caused by GameDay Pro-provided software, branding, app content, or materials.

This indemnity does not apply to claims arising from:

• User Content
• Club names, course names, game names, league names, logos, images, messages, advertisements, sponsor content, scores, game data, or other materials submitted, selected, uploaded, published, displayed, or controlled by users, subscribers, clubs, organizers, advertisers, or sponsors
• Use of the Services in violation of these Terms or applicable law
• Modifications not made by GameDay Pro
• Combination of the Services with materials, data, software, branding, or content not provided by GameDay Pro
• Use of the Services after GameDay Pro provides notice to stop using the allegedly infringing material or feature
• Unauthorized use of the Services
• Any wagering, prize, competition, advertising, sponsorship, or promotional activity created or managed by users, subscribers, clubs, organizers, advertisers, or sponsors
• Claims based on materials or instructions provided by the subscriber or another user

19. Remedies for Infringement Claims

If GameDay Pro reasonably believes the Services may infringe a third party’s intellectual property rights, GameDay Pro may, at its option:

• Modify the Services so they are non-infringing
• Obtain a license or right for continued use
• Replace the affected feature or content with a substantially similar non-infringing alternative
• Remove or disable the affected feature or content
• Suspend or discontinue the affected feature
• Terminate the applicable subscription and provide a prorated refund of prepaid, unused subscription fees for the affected period

20. Indemnification Procedure

A party seeking indemnification must:

• Promptly notify the indemnifying party of the claim
• Reasonably cooperate in the defense of the claim
• Allow the indemnifying party to control the defense and settlement of the claim

The indemnifying party may not settle any claim in a way that admits fault or imposes non-monetary obligations on the indemnified party without that party’s prior written consent.

Failure to provide prompt notice may reduce the indemnifying party’s obligations to the extent the delay prejudices the defense.

21. Exclusive Remedy for Covered IP Claims

Sections 18, 19, and 20 state GameDay Pro’s sole obligation, and the subscriber’s exclusive remedy, for third-party intellectual property infringement claims covered by those sections.

22. Suspension and Termination

GameDay Pro may suspend or terminate your access to the Services at any time if GameDay Pro believes that:

• You violated these Terms
• Your use of the Services creates legal, security, operational, or reputational risk
• Your User Content may violate applicable law or third-party rights
• Your account is being used fraudulently or unlawfully
• Payment is overdue, if applicable
• Suspension or termination is necessary to protect GameDay Pro, users, subscribers, or third parties

You may stop using the Services at any time.

Upon termination, your right to access and use the Services will end.

Sections that by their nature should survive termination will survive, including sections relating to intellectual property, disclaimers, limitation of liability, indemnification, governing law, and dispute resolution.

23. Changes to the Services

GameDay Pro may modify, suspend, discontinue, or remove features, functionality, content, or portions of the Services at any time.

GameDay Pro is not liable for any modification, suspension, or discontinuation of the Services or any feature.

24. Changes to These Terms

GameDay Pro may update these Terms from time to time.

If changes are material, GameDay Pro may provide notice through the Services, by email, or by other reasonable means.

Your continued use of the Services after updated Terms become effective means you accept the updated Terms.

If you do not agree to the updated Terms, you must stop using the Services.

25. Governing Law

These Terms are governed by the laws of the Commonwealth of Massachusetts, without regard to conflict of law principles.

26. Dispute Resolution

Before filing a claim, you agree to first contact GameDay Pro and attempt to resolve the dispute informally.

Any dispute arising out of or related to these Terms or the Services will be brought in the state or federal courts located in Massachusetts, unless applicable law requires otherwise.

You consent to the personal jurisdiction and venue of those courts.

27. No Professional Advice

GameDay Pro does not provide legal, financial, gambling, tax, accounting, handicapping, tournament administration, or professional sports-governance advice.

Any decisions regarding competitions, prizes, payouts, rules, eligibility, handicaps, scoring, or legal compliance are the sole responsibility of users and organizers.

28. Miscellaneous

These Terms constitute the entire agreement between you and GameDay Pro regarding the Services.

If any provision of these Terms is found unenforceable, the remaining provisions will remain in full force and effect.

GameDay Pro’s failure to enforce any provision of these Terms is not a waiver of its right to do so later.

You may not assign these Terms without GameDay Pro’s prior written consent. GameDay Pro may assign these Terms in connection with a merger, acquisition, sale of assets, reorganization, or by operation of law.

GameDay Pro uses SMS messaging to send one-time passcodes for mobile number verification and to deliver club invitation messages to users who have been invited to join a club. SMS is delivered via third-party providers (including Twilio). By providing your phone number and opting in, you agree to these terms.

Consent

• By providing your mobile number, you authorize GameDay Pro to send SMS messages for account verification and club invitations.
• Message frequency varies based on your games/leagues and organizer activity.
• Message and data rates may apply.

Opt-out / Help

• Reply STOP to any message to opt out of SMS messages.
• Reply HELP for assistance.
• Reply START to re-subscribe after opting out.

Delivery & availability

• SMS delivery is not guaranteed and may be delayed or blocked by carriers or device settings.
• We are not liable for delayed or undelivered messages, carrier outages, or user device configurations.

Appropriate use

• Do not use GameDay Pro SMS features to harass users or send unlawful content.
• Organizers are responsible for inviting only users who consent to receive messages.

GameDay Pro may display advertisements and/or sponsorship messages inside the app. To protect users and reduce risk, all ads must comply with this policy. We reserve the right to reject, pause, or remove any advertisement at our sole discretion.

Prohibited content

• Illegal products/services, or instructions to facilitate illegal activity
• Hate, harassment, threats, bullying, or discrimination
• Sexually explicit content or adult services
• Violence, gore, or promotion of self-harm
• Weapons sales (including firearms, ammunition, and accessories), explosives
• Fraud, scams, deceptive claims, “get rich quick,” or misleading pricing
• Infringing content (copyright/trademarks) or impersonation
• Collection of sensitive personal data via ads (e.g., SSN, passwords)

Restricted content (requires approval)

• Alcohol (where permitted), gambling promotions (where permitted), political ads
• Health/fitness claims (must be substantiated and non-deceptive)
• Financial products/services (must be compliant and non-misleading)

Quality standards

• Ads must be clear, accurate, and not misleading
• Landing pages must match the ad and be safe (no malware, no forced downloads)
• No popups or disruptive behavior that interferes with game functionality

Enforcement

We may remove ads without notice and suspend advertisers for repeated violations. Users can report ads via support@gamedaypro.io.

App Functionality

• Users create, join, and manage games and leagues
• Scoring and participation are user-entered
• Ads and sponsorships may be displayed
• SMS and push notifications support game coordination

Data Usage

• Data is used to operate the app
• Data is not sold
• Third-party services support analytics, payments, and messaging

Payments

Payments are processed by third-party providers.
